OFFICIAL IOGEAR CONTEST RULES

NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.

All winners must be 18 years of age or older and a resident of the United States, unless otherwise stated and/or posted.

1. Entering Contests and Choosing and Contacting Winners

Winners of Twitter based contests will be chosen at random from all Twitter follower entries received that comply with the rules outlined in the contest announcement(s).

Entrants must become a Twitter follower or be an existing Twitter follower and include all other specific entry information that is required in the contest announcement on the IOGEAR Twitter follower page.

IOGEAR is not responsible for errors or omissions attributable to the Twitter website regardless of the reason.

Winners will be contacted through Twitter. The person who receives and replies to the winner announcement email will be considered the winner unless he/she identifies another person as the winner in his/her email reply. IOGEAR will mail the contest prize to the address supplied by the winner.

Only one entry per Twitter profile is allowed unless multiple entries are permitted in the individual contest posting. Unless otherwise specified in an individual contest posting, no person may enter any contest more than once using multiple Twitter profiles.

Before receiving the prize, the winner must send a reply to IOGEAR from the Twitter profile he/she used to enter the contest within 30 days of being notified of winning the contest. If the winner fails to respond to the winner announcement Twitter message or sends his/her reply from a Twitter profile other than the one from which the original contest entry was sent, he/she forfeits the prize. There is no guarantee that IOGEAR will award the prize to another entrant if it is forfeited by the chosen winner.


2. Submission of photo, text or other media for Contests

Entries selected for display and that win “best of” contests and/or any other contest requiring a photo, text or other form of media from entrants will be judged entirely at the discretion of IOGEAR.

By submitting a photo, text, or other form of media to IOGEAR, you hereby grant to IOGEAR and its employees, affiliates, subsidiaries, licensees and assigns, an irrevocable, perpetual and royalty-free right to use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish and otherwise make use of the submitted photo, text or other form of media in any and all forms of media, whether now known or hereinafter created, throughout the world and for any purpose. In addition to other rights, the rights granted to IOGEAR include but are not limited to the right to resize, crop, censor, edit, compress, feature, caption, affix logos to, and otherwise alter or make use of the submitted photo, text or other form of media.

By submitting any photo, text, or other form of media to IOGEAR, you hereby represent and warrant that the submitted photo, text, or other form of media does not: infringe on any third party’s patent, trademark, copyright, or other intellectual property right; does not invade any third party’s right of privacy; does not constitute a public disclosure of private facts; does not appropriate a third party’s name, likeness, image or identity; and does not place a third party in a false light. Additionally, you hereby represent and warrant that you have the authority to grant any and all rights and licenses granted to IOGEAR herein, including but not limited to all necessary trademark rights and copyrights, and that said rights and licenses are free and clear of any claims or encumbrances.

You acknowledge and agree that IOGEAR shall have no obligation to post, display or otherwise make publicly available any photo, text or other form of media submitted by you, and may, in its sole and unfettered discretion, remove, edit, modify or delete any photo, text, or other form of media that you submit to IOGEAR.

You understand and intend that any photo, text, or other form of media submitted by you to IOGEAR may be available for viewing, rating, review, and comment on by the public, and understand that any comment or rating with which you disagree or are unhappy about may still be published by IOGEAR or otherwise become associated with any photo, text, or other form of media you submit to IOGEAR. By submitting any photo, text, or other form of media to IOGEAR, you hereby waive any right to privacy that you may have regarding said photo, text, or other form of media submitted by you to IOGEAR.

Photos, text, or other forms of media submitted by you to IOGEAR shall be considered the property of IOGEAR and IOGEAR shall have no obligation to preserve, return or otherwise make available to you or others any photos, text, or other forms of media so submitted.


3.  Release and Indemnification

EXCLUDING ONLY APPLICABLE MANUFACTURERS' WARRANTIES, THE PRIZES ARE PROVIDED TO WINNERS "AS IS" WITHOUT FURTHER WARRANTY OF ANY KIND. SPONSOR DISCLAIMS ALL FURTHER WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE WITH RESPECT TO THE PRIZES. IN NO EVENT SHALL SPONSOR BE RESPONSIBLE HEREUNDER FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES INCURRED BY ANY ENTRANT OR ANY THIRD PARTY EVEN IF SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In exchange for participating in an IOGEAR contest, you hereby agree to indemnify and hold harmless IOGEAR, its employees, affiliates, subsidiaries, licensees, sponsors and assigns from any and all claims of any type or nature which are related to or arise from any IOGEAR contest in which you participate. Furthermore, you hereby waive any right you might have to pursue IOGEAR for any claim of any type or nature that arises from or is related to any IOGEAR contest in which you participate.


4. Awarding Prizes

Winners are solely responsible for any/all taxes and/or fees which may result from winning a contest.

Each winner must supply IOGEAR with his/her legal name, mailing address, birth date, and daytime and nighttime telephone numbers.

A request for a substitute or alternative prize will not be granted. If the specified prize becomes unavailable due to unforeseen circumstances, IOGEAR may substitute a prize of like or equal value.

IOGEAR’s employees and their family members are prohibited from winning any prize.
